Welcome, I am Gregory Clark, a Seattle-based nature photographer. I have created this Website as a Photographic Stock Agency for instant purchase and download of thousands of digital files. An introduction to my work can be seen in the Photo Galleries of Flora, Expressions, Natural World, and Coffee World. These photographs are a representation of a much larger body of color and black and white photographs which are available for purchase either as royalty-free images, or through a flat-rate pricing, from our instant download data base. All images are available as high- and low-resolution digital files. Images represented on this site draw from my diverse background in photojournalism, nature photography, commercial advertising, and fine art. My goal is to create a unique look at the natural and man-made worlds through techniques using infra-red film, lens distortion, emulsion transfer and digital coloration. The photographs sold at GregoryStock.com site are primarily of the natural world and have been published by arboreta, botanical gardens, text book companies, calendar companies, commercial enterprises and fine art galleries, and have been used for arboretum brochures, magazines, advertising, editorial, display posters, POP, packaging, website, multimedia and fine art prints. Of particular interest to me has been the Hawaiian Islands and their vast flora abundance. In addition, I have created six coffee Posters depicting the growing and serving of coffee. Keeping an abundance of fresh and exciting flora and artful photographs available for viewing is my greatest endeavor. A variety of digital files are available for sale through our photo stock agency. In addition to realism represented in our photographic images you will also find abstract images that have been digitally enhanced, resulting in “applied art.” My photographic vision reveals a rather abstract view of the geometric and architectural structures of blossoms and plants. This allows a very detailed and intimate view of the secrets of the flora world. While observing the images, I hope you will find that the automatic references of certain structure will be missing and that the focus points are counter to your experience and expectations. This abstraction, or unbalance, speaks to the honesty of nature and the strangeness and unpredictability of its rhythms. Further examples of this metaphysical art are represented in the black and white infra-red images and the emulsion color-transfer photographs showing the simple and complex structures of flowers. Successfully exposing this temperature sensitive film requires a broad experience base and a little luck. I discovered that most jungle setting with extreme temperatures and humidity posed an exciting challenge. The results of these experiences can be seen in the image data bases. “Flora Photography Gallery” depicts literal and fine art photographs of exotic flowers, flower interiors, trees, and rare foliage in color and black and white images. These photographs were made from the flowers and plants from the Hawaiian Islands, Costa Rica, St. Thomas V.I., St. Barts, , St. Maarten, Puerto Rico, Spain, Ibiza, and Italy . Flower blossoms, rare fruit, exotic plants and leaf structures are most fascinating to me. The larger body of my work centers around tropical flora with great emphasis on Hawaiian Island botanicals and endangered plant species. My searching has led me to exotic locations such as the oceanic island of Kaua’i where the climate, ocean and lush green mountains stimulate the senses, creating a wide choice of photographic discovery. Most macro-photographic exposures of jungle flora were accomplished with only natural, available light, which can be extremely limited under lush, dense forest canopy. Many images found in this site has been photographed with infra-red film and printed as black and white silver-based or sepia toned silver based prints.

“Expressions Photographic Gallery” This category of flora and man-made structures is represented by imagery that expands on the natural beauty of our world. Curiosity and discovery are the creative juices that drive my photographic fascination with the natural and man-made worlds. The flower structure, including the stamen, style, stigma, corolla, filament, and anther reveal such a fascinating mesh of architectural uniqueness which can only be witnessed through a camera lens. Within this category distortions and changed realities, obtuse views and perceptions, collide with the seemingly ordered world of nature. The excitement of seeing becomes most important, and struggling to capture my vision on film becomes my challenge. This expression provides a platform for the use of infrared film and emulsion color transfers. The results are very exciting and unique. They can never to be duplicated. When photographed with alternate processes, viewing the mammoth Banyan or fig (Ficus benghalensis) and Rain Tree (Samanea saman) reveals a structure, a living architectural feat, which supports an enormous network of life and strength. Man’s architecture also is revealed in photographs using the same types of sensory manipulation and abstraction.

This photographic section contains a large collection of images depicting the growing, harvesting, processing and producing of coffee in equatorial regions of the Americas . The collection further depicts the processing of the red coffee berry to finished roasted coffee bean. Images also take you through husking, fermentation of red berry, air and drum drying, parchment removal, grading and transporting of the green coffee bean. Coffee roasting and packaging rounds out the production cycle in this collection. The “Coffee World” images include coffee extraction with espresso making processes. Many still-life images of coffee cups and coffee serving presentations have been staged in the studio and many have been shot in espresso houses and cafes. Searching by Category :

On the GregoryStock site you can search using Category. We have indexed and cross-referenced our images by category. Please use the pull-down menu under the caption ‘Category’ to select the appropriate category you wish to search. Once you have picked a category you can either see all the images in that category, or focus your search by entering keywords in the ‘Keyword’ field. By clicking on the ‘Search’ button, you will arrive at a page of thumbnail images that meet your search criteria. You can click on any thumbnail to enlarge the image.

Searching by Keyword :

This method is best for an initial search. You can further limit the results you receive by entering additional keywords. Our database will use the additional keywords to search within your previous search results. Best results will be obtained by keeping your keywords simple. Use well-known words in the singular and watch your spelling. List of words are better separated by a comma. We have made every effort to include both common names and botanical, or Latin, names in our database, and comprehensive descriptors for each image.

GregoryStock Royalty Free & Flat Rate License Agreement

1. Basic Information
By purchasing from us, you (User) agree to be bound by the terms of this agreement. GregoryStock grants you a non-exclusive and non-transferable license for the use of the Image(s) only as provided below. All other rights to the Image(s) including copyright and all other rights are retained by GregoryStock. This License is effective until it is terminated. You can terminate this License by destroying the Image(s), along with any copies or archives of it, and any CD-ROM or accompanying materials (if applicable), and ceasing to use the Image(s) for any purpose. The License also terminates if at any time you fail to comply with the terms of this Agreement. If this happens, you hereby agree to destroy all copies and archives of the Image(s), to cease using the Image(s) for any purpose, and to confirm to GregoryStock in writing that you have complied with these requirements.

2. License
(a) Number of Users:
THIS IS A NINE (9) PERSON MULTI-LICENSE AGREEMENT. You and eight (8) other designated people are permitted to use the Image(s). THIS IS NOT A SIMULTANEOUS USE LICENSE. You may not allow more than nine designated people, whether employees or contractors, access to or use of the Image(s), even if only nine people are using the Image(s) at the same time. You may not use the Image(s) on a server or create any other image library that permits access to more than nine designated people.

(b ) Allowed Uses. You may:
(i) Back up, copy, or archive the Image(s) as necessary for internal use, and only as necessary for that use. Any copy or archive you make must include the Image's copyright information.

(ii) Use the Image(s) in any electronic or print media, including advertising and editorial use, and consumer merchandise.

(iii) Use the Image(s) for any items for resale, including book covers and consumer merchandise, provided these products are not intended to allow the re-distribution or re-use of the Image(s).

(iv) Modify or alter the Image(s) as necessary for your use, as allowed for elsewhere in these terms and conditions, provided that the rights to any derivative work shall belong to GregoryStock. You may use such derivative work only as permitted in accordance with these terms and conditions. All copyrights with respect to such derivative work are assigned to GregoryStock, which assignment the parties hereby agree is valid under the U.S. Copyright Law. If requested by GregoryStock, you agree to execute a written assignment of any such copyrights with respect to such derivative work.

(v) In the normal course of workflow, convey to a third party (such as a printer) temporary copies of the Image(s) that are integral to your work product and without which the product could not be completed.

(c) Restrictions as to Use: You may not:
(i) Use the image(s) beyond the terms of the limited license agreement without first obtaining an additional license.

(ii) Create any derivative use of an image(s) unless indicated on the invoice.

(iii) Use the image(s) in a manner that is defamatory, pornographic, or obscene, whether directly or in context or juxtaposition with specific subject matter.

(iv) Remove any copyright or trademark from any place where it appears on the Image(s) or its accompanying materials.

(v) Use image(s) in any way that violated a depicted persons right of privacy or publicity or to infringe on any trade name, trade mark, or service mark.

(vi) Archive, re-publish, or transmit image(s) on any database without GregoryStock’s prior written consent.

(vii) Copy or publish any image(s) to a network or otherwise distribute to or use by anyone other than authorized users, without prior written consent from GregoryStock.

(viii) Sub-license, re-license, rent or lease any of the images.

(ix) Use of the images to promote a business that sells or licenses illustrative or photographic images or otherwise competes with GregoryStock in any manner.

(x) Ship, transfer or export any image(s) into any country or to use any of the images in any manner prohibited by any export laws, restrictions, or regulations.

(d) Agents
Agents are granted the rights listed in this agreement provided that these rights are used solely in a final product published by a single client as the final end user.

3. PAYMENT TERMS
All Sales are Final , except as provided in our Refund Policy. No rights are granted until the invoice is paid in full.

4. PHOTO CREDIT
GregoryStock r equests the phrase “Photo: GregoryStock.com” appear adjacent to the Image or on a credit page.

5. WARRANTY

NO WARRANTY

GregoryStock GIVES NO RIGHTS OR WARRANTIES WITH RESPECT TO THE USE OF NAMES, TRADEMARK, LOGO TYPES, REGISTERED OR COPYRIGHTED DESIGNS OR WORKS OF ART DEPICTED IN ANY PICTURE, AND THE USER MUST SATISFY ITSELF THAT ALL NECESSARY RIGHTS, CONSENTS OR PERMISSION AS MAY BE REQUIRED FOR REPRODUCTION ARE SECURED. GREGORYSTOCK IDENTIFIED THE CAPTION FOR EACH IMAGE TO THE BEST OF ITS ABILITY, BUT CANNOT BE HELD RESPONSIBLE FOR ERRONEOUS OR INCOMPLETE CAPTION INFORMATION.

In any event and under all circumstances, the limit of liability of GregoryStock shall be the sum paid to GregoryStock per the invoice for the use of the image involved.

6. DELIVERY OF DIGITAL IMAGES

DIGITAL FILES ARE PROVIDED “AS IS.” GregoryStock MAKES NO REPRESENTATION OR WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDED BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, NONINFRINGEMENT, QUALITY OF IMAGE, OR COMPATIBILITY WITH ANY COMPUTER HARDWARE OR OTHER EQUIPMENT, OPERATING SYSTEM OR SOFTWARE PROGRAM.

GregoryStock MAKES NO REPRESENTATION OR WARRANTIES AS TO THE ACCURACY OF THE CONTENT, OR THAT THE USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. THE USE OF THIS SITE IS AT YOUR OWN RISK.

YOU MAY HAVE ADDITIONAL RIGHTS UNDER SOME STATE LAWS.

7. LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES WILL GregoryStock OR THE OWNER OF THE IMAGES BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR PUNITIVE DAMAGES AS A RESULT OF THE USE OF THIS SITE OR FROM YOUR ACCESS OR USE OF THE IMAGES ON THIS SITE. IN ANY EVENT, THE LIMIT OF LIABILITY OF THE COPYRIGHT OWNER OF THE IMAGE AND AGENT SHALL BE THE FEE PAID FOR THE IMAGE TO AGENT.

You agree to indemnify and hold GregoryStock, and the Photographer and/or Illustrator, harmless from any and all claims, liabilities, damages, costs and expenses, including reasonable attorney’s fees, arising from the use of an Image or any breach of this agreement.

8. LIMITATION OF REMEDIES
a) GregoryStock Refund Policy:

We guarantee your satisfaction with our images. If for any reason you are not satisfied, please let us know what the situation is and we will work with you to fix it.

If you have downloaded an image from our web site, or if we have shipped an image or disc to you, we require a signed affidavit from you, that you will not be using the image/s in any way. View and print the affidavit by clicking here, or contact us and we'll send it to you. Fill it in and fax it back to us. We will process your request per our refund policy

REFUND POLICY
Royalty-Free & Flat-Rate:

Single Images

Within 3 days of invoice date, full refund with signed affidavit.
Within 14 days of invoice date, $25 ( U.S. ) handling fee with signed affidavit.
After 14 days of invoice date, no refund.

Discs

CDs: Within 1 week of invoice date, full refund will be applied with return of signed affidavit and CD.

After 1 week and up to 2 weeks of invoice date, 50% refund will be applied with return of signed affidavit and CD.

After 2 weeks of invoice date, no refund.

*Shipping charges will not be refunded unless GregoryStock is responsible for the error.

9. ADDITIONAL RIGHTS:
If you would like to discuss the acquisition of further rights than are provided for under this Agreement, please Contact US concerning a custom license.

10. DISPUTES
Any and all disputes under or in connection with this agreement shall be settled by arbitration in Seattle , Washington , pursuant to the rules of the American Arbitration Association. Judgment upon the award rendered may be entered in the highest court of the forum, State, or Federal, having jurisdiction. This agreement, its validity and effect, shall be interpreted under and governed by the laws of the State of Washington . If user of this contract is an agent for or an employee of a non-US company, but operates in a place of business in the United States or its territories, said User expressly agrees that any dispute regarding this contract shall be adjudicated within the United States in the manner described herein. If GregoryStock is caused to present claims or suit as a result of any breach of the above terms set forth, it shall be made whole for such reasonable legal fees or costs by User.

11. ASSIGNABILITY

This agreement is not assignable or transferable on the part of the User.

12. ENTIRE CONTRACT
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND GregoryStock, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU AND GregoryStock RELATING TO THE SUBJECT OF THIS AGREEMENT. THE EXPLANATIONS TO FAQ'S AND OTHER EXPLANATIONS AND CONTENT PROVIDED IN GregoryStock’s WEBSITE ARE FOR YOUR INFORMATION ONLY AND ARE NOT, AND SHALL NOT BE CONSTRUED AS, PART OF THIS AGREEMENT.

IMAGE SPECIFICATIONS :

Our photos are scanned using a professional film scanner, from color transparency and black-and-white negative, or are digitally captured. All images have been retouched and color and contrast balanced. Our color film based photos are saved in RGB files which allow easy adaptation of color files and print medium. Our applied art images have been digitally manipulated from color transparencies to create unique art, and are also saved in RGB files as above.

GregoryStock’s images are ready to use in a professional way. They have been optimized for eventual RGB to CMYK color separation for all off-set printing requirements limited only by the file size. Our images can be used in many different ways, of which printing is only one. RGB images preserve the original luminosity of the image and are suitable for use in multimedia and internet applications. In addition, RGB format allows professionals to create CMYK separations according to their desired print medium.
